(Nairobi, Kenya) — The Federal High Court Lideta Division, First Instance Time-Appointed Bench, has granted law enforcement a 14-day investigation window regarding 41 individuals attached to the Ministry of Revenue, including department directors, technical experts, and external associates linked to alleged systemic tax collection offenses.
The decision followed a session where police investigators maintained that additional time is required to quantify financial damages, perform financial audits, and clarify individual responsibilities within what authorities describe as an organized financial crime scheme.
In court, police presented a preliminary investigation file alleging widespread economic offenses affecting state revenue operations. Investigators told the bench that due to the multi-tiered nature of the suspected network, completing comprehensive financial audits and gathering further physical evidence requires keeping the suspects in custody.
Legal counsel representing the 41 suspects strongly contested the remand request, arguing that state prosecutors failed to present specific evidence tying individual clients to the allegations. Defense lawyers asked the court to grant bail, maintaining that general accusations should not deny their clients their constitutional right to conditional release.
Following a review of both preliminary police filings and defense arguments, the presiding bench found sufficient grounds to allow extended detention for investigative purposes. Consequently, the court granted the full 14-day extension requested by law enforcement.
The court explicitly ordered police to guarantee proper healthcare access and humane detention conditions for all 41 suspects during their time in custody.
According to a public statement released by the Federal Ethics and Anti-Corruption Commission, court proceedings to review the updated investigation file are set for August 21 and 22, 2026.
